Do You Need a Spousal Visa?


A CR-1/IR-1 spousal visa allows the spouse of a U.S. citizen to join you in the U.S. as a conditional resident. If your spouse is an alien who wishes to enter the U.S. in order to live and work there, they need to apply for a CR-1 / IR-1 visa. The benefit is that your foreign spouse becomes a Lawful Permanent Resident from the moment they enter U.S. territory (and they receive a Green Card at their U.S. address).


If you are a U.S. citizen who married overseas and you want to bring your foreign spouse to the United States, you can sponsor a K-3 visa for your alien spouse. With a K-3 visa, your spouse may come to the U.S. and will then be able to apply for a Green Card (adjustment of status to Lawful Permanent Resident). So the K-3 Visa has an extra step, compared to the CR-1 / IR-1 visa.

How to Get a Spouse Visa?

The Spouse Visa process is complex and it usually takes between 8 and 12 months to go through the 3 steps listed below.
File your petition with the USCIS

In this initial step, you will need to gather all necessary documents and supporting evidence, fill in the Petition for Alien Relative, and file it with the United States Citizenship & Immigration Service. We are here to help you from the very beginning and streamline the process.

As soon as your Petition for Alien Relative is approved, your case is handed over to the National Visa Center for additional review. The NVC may require more information, or supporting evidence. Embassy Interview

Your spouse will need to fill in a nonimmigrant visa application, schedule, and attend a face-to-face interview with a consular officer. Prior to the interview, the applicant will need to schedule and attend a medical examination. During the interview, your spouse will answer a series of questions regarding their relationship to you, to prove that their visa case is genuine. It usually takes 5 to 15 minutes. Your spouse might also be required to present more additional information. You will usually get a determination whether or not your visa is approved at the end of the interview.
