Do You Need a K-1 Fiancé(e) Visa?

If you are a U.S. citizen who wants to bring their foreign fiancé(e) to the United States in order to get married, you will need to obtain a K-1 nonimmigrant visa for your fiancé(e). Having a K-1 visa, your fiancé(e) will be allowed to travel to the U.S. and marry you there within 90 days of arrival. Both you and your fiancé(e) must prove that you intend to establish a life together and that the marriage is not solely a way to obtain an immigration benefit.

After the marriage, your fiancé(e) – now spouse – will be able to apply for a Green Card (adjustment of status to Lawful Permanent Resident).

In case you plan to marry outside the U.S., you already got married, or your fiancé(e) is already residing legally in the U.S., your spouse or fiancé(e) is not eligible for a K-1 visa. Visit our Spouse Visa page for more information about how to help your foreign spouse apply for a Green Card.

Are You Eligible for a K-1 Fiancé(e) Visa?

Even though the K-1 visa requirements are the same for all applications, the USCIS staff and the Consular officer might have additional requirements. We are here to carefully review your case and make sure you meet all the conditions.

As a petitioner, you must:

  • Be a U.S. citizen.
  • Be legally able and free to marry.
  • Have physically met your foreign fiancé(e) within the past 2 years.
  • Have a clean criminal record.
  • Meet the income requirement.

As a beneficiary, your fiancé(e) must:

  • Be a resident of a foreign country.
  • Be legally able and free to marry.
  • Intend to marry the U.S. citizen within 90 days after you enter the United States.

How to Get a K-1 Fiancé(e) Visa?

The K-1 Fiancé(e) Visa process is complex and it usually takes between 7 to 10 months to go through the 3 steps listed below.
File your petition with the USCIS

In this initial step, you will need to gather all necessary documents and supporting evidence, fill in the Petition for Alien Fiancé(e), and file it with the United States Citizenship & Immigration Service. We are here to help you from the very beginning and streamline the process.

National Visa Center Review

As soon as your Petition for Alien Fiancé(e) is approved, your case is handed over to the National Visa Center for additional review. The NVC may require more information, or supporting evidence. Once the NVC determines that your application is compliant, it will be forwarded to the U.S. Embassy or Consulate closest to your fiancé(e). We offer step-by-step support throughout the process.

Embassy Interview

Your fiancé(e) will need to fill in a nonimmigrant visa application, schedule and attend a face-to-face interview with a consular officer. Prior to the interview, the applicant will need to schedule and attend a medical examination. During the interview, your fiancé(e) will answer a series of questions regarding their relationship to you, to prove that their visa case is genuine. It usually takes 5 to 15 minutes. Your fiancé(e) might also be required to present more additional information. You will usually get a determination whether or not your visa is approved at the end of the interview. We’re here to support you along the way, streamline the entire process, and boost your visa approval chances.
